An Australian registered migration agent (immigration advisor) who practises in Australia must be registered with the Office of the Migration Agents Registration Authority (OMARA). This organisation sits under the Australian Government’s Department of Home Affairs. According to the Australian Migration Act Section 280, it is illegal for any person (other than a small number of exempted persons) in Australia who is not registered to provide immigration advice and assistance, regardless of whether they are charging any fees or not. The maximum penalty is 10 years imprisonment.
